Introduction to the general conditions of sale
Our sales are subjected to the present general conditions which prevail on any other stipulation emanating from the purchaser. Any order addressed by the purchaser carries his adhesion without restriction nor reserve to the present general conditions of sale. Moreover, the present general conditions of sale aim at informing any possible buyer on the conditions in which the seller proceeds to the sale and the delivery of the ordered products.

Article 1 – Purpose

The present conditions govern the sales by Camaya.

Article 2 – Prices

The prices of our products are indicated in euros including all taxes in the store and in the shopping cart (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs.
In case of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums do not fall under the jurisdiction of Camaya
They will be at your expense and are your responsibility, both in terms of declarations and payments to the authorities and competent bodies in your country. We advise you to inquire about these aspects with your local authorities.
All orders, regardless of their origin, are payable in Euros.
Camaya reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the rate in force at the time of the validation of the order and subject to availability.
The products remain the property of Camaya until full payment is received.
Warning: as soon as you take physical possession of the ordered products, the risks of loss or damage to the products are transferred to you.

Camaya reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, especially in case of supply problems, or in case of difficulty concerning the order received.

Article 4 – Validation of your order

Any order appearing on the Internet site www.camaya.fr supposes the adhesion to the present General Conditions. Any confirmation of order involves your full and complete adhesion to the present general conditions of sale, without exception or reserve.

All the data provided and the recorded confirmation will be worth proof of the transaction.

You declare that you are fully aware of this.

The confirmation of the order will be worth signature and acceptance of the operations carried out.

A summary of the information of your order and these General Conditions, will be communicated to you in PDF format via the e-mail address of confirmation of your order.

Article 5 – Payment

The fact of validating your order implies for you the obligation to pay the price indicated.

The payment of your purchases is made by credit card through the secure system stripe.

The debit of the card is made only at the time of the expedition of the order. In case of split deliveries, only the shipped products are debited.

The customer can pay by check, make your check payable to Camaya and send it to the address: 2 allée des frênes, 33740 Arès.

The date of receipt of the check is the date the order is processed and shipped. An e-mail acknowledging receipt of payment will then be sent to you.

Article 6 – Withdrawal

In accordance with the provisions of the article L.121-21 of the Code of the Consumption, you have a time of retractation of 14 days as from the reception of your products to exert your right of retractation without having to justify reasons nor to pay penalty.

Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be of a nature to defeat the right of withdrawal.

The return costs are at your expense.

If you exercise your right of withdrawal, Camaya will reimburse the sums paid within 14 days following notification of your request and via the same means of payment as that used for the order.

In the event of an error in the order or an exchange for personal convenience, shipping costs are at the customer’s expense.

The right of withdrawal is accepted only for products in their original and complete condition (packaging, accessories, instructions) without trace of use. Products wrapped in plastic or sealed will only be accepted if they are in their original packaging or if they have not been unsealed. A product returned incomplete, damaged or soiled by the customer will not be refunded by Camaya.

Article 7- Availability

Our products are offered as long as they are visible on the site www.camaya.fr and within the limits of available stocks.

In case of unavailability of product after placing your order, we will inform you by mail. Your order will be automatically cancelled and no bank debit will be made.

In addition, the website www.camaya.fr is not intended to sell its products in large quantities. Therefore, Camaya reserves the right to refuse orders of more than 30 items due to manufacturing time constraints.

Article 8 – Delivery

The products are delivered to the delivery address indicated during the ordering process, within the time period indicated on the order validation page.

In case of delay in shipment, an email will be sent to you to inform you of a possible consequence on the delivery time that has been indicated.

In accordance with the legal provisions, in the event of delay of delivery, you benefit from the possibility of cancelling the order in the conditions and methods defined in the article L 138-2 of the Code of the Consumption. If in the meantime you receive the product, we will proceed to its reimbursement and to the delivery costs under the conditions of the article L 138-3 of the Code of the Consumption.

In the case of deliveries by a carrier, Camaya cannot be held responsible for late delivery due exclusively to the unavailability of the customer after several proposed appointments.

The taxes (local, customs, import) are charged to the customer, Camaya disclaims any liability if the payment of taxes is not made by the customer. Deliveries are made by mail (colissimo, chronopost, book and brochure …), the product is sealed under plastic film, checked and carefully packaged before its deposit in the post office. If upon receipt you notice a deterioration of the packaging, I advise you to open it directly in the post office to make note of the deterioration.and to approach the carrier chosen, chronopost, colissimo or the post office in case of problem.*

Article 9 – Guarantee

All our products benefit from the legal guarantee of conformity and the guarantee of the hidden defects, envisaged by articles 1641 and following of the Civil code. In case of non-conformity of a product sold, it can be returned, exchanged or refunded.

All claims, requests for exchange or refund must be made by mail within 30 days of delivery.

The products must be returned to us in the state in which you received them with all the elements (accessories, packaging, instructions…). The shipping costs will be reimbursed to you on the basis of the invoiced rate and the return costs will be reimbursed to you on presentation of the receipts.

The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided in Article 6.

Article 10 – Responsibility

The products offered are in accordance with the French legislation in force. The responsibility of Camaya cannot be engaged in case of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with the local authorities on the possibilities of importing or using the products or services that you plan to order.

Furthermore, Camaya shall not be held responsible for any damage resulting from improper use of the product purchased.

Finally, Camaya shall not be held responsible for any inconvenience or damage inherent to the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.

Article 11 – Applicable law in case of disputes

The language of this contract is the French language. The present conditions of sale are subject to French law. In case of dispute, the French courts will have exclusive jurisdiction.

Article 12 – Intellectual property

All elements of the site www.camaya.fr are and remain the exclusive intellectual property of Camaya. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or audio. Any simple link or hypertext link is strictly prohibited without the express written consent of Camaya.
